We want to protect the data of visitors to our website (hereinafter: "Visitors") from loss, leaks, errors, unauthorized accesses and any other unlawful processing.

We will therefore process your personal data only in accordance with the European Regulation of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter: "AVG") as well as the Law of July 30, 2018 on the protection of natural persons with regard to the processing of personal data.

With this privacy statement, Tunity aims to inform you as a data subject, within the meaning of the AVG, about the processing operations and to provide you with conclusive information, among other things, about the types of personal data we collect about you, where we get the data from, how we use the data, which we collect about you, how long we keep your data, to whom we may disclose this information, and your rights regarding the processing of your personal data.

Tunity wishes to inform you that the provision of certain mandatory personal data is a necessary condition for providing our services. In the absence of the aforementioned personal data, the services cannot be offered by Tunity.

Where necessary, we will ask you, the data subject, for informed, free, unambiguous and specific consent to carry out certain processing operations. 

It is possible that our privacy policy may be subject to adjustments and changes in the future. These will be made clear in our Privacy Statement. 5. FOR WHAT PURPOSES ARE YOUR PERSONAL DATA PROCESSED

Tunity processes your personal data in order to correctly provide the services you have requested or received, as well as to offer the functionalities of the website correctly and intuitively, and where necessary to respond appropriately to your requests. Tunity also processes your personal data to provide you as a Visitor to the website with a safe, optimal and personalized user experience.

The processing of personal data of Customers and Visitors is primarily for the following specific purposes:

  • Allowing us to contact you in response to your specific request via contact form or email;

8. YOUR RIGHTS AS A DATA SUBJECT


8.1. Guarantee of compliance with principles specific to the processing of personal data

Tunity only processes your personal data:

  • In accordance with the purposes as herein provided or in a manner not incompatible with this original purpose;

  • In a proper, lawful and transparent manner where the processing, as appropriate, is supported by the following legal grounds:

    • Consent: personal data are processed following your consent.

    • Legitimate interest: the personal data can be processed if it is in the legitimate interest of Tunity as a company, insofar as your personal interests do not outweigh this.

    • Agreement: the processing of personal data is necessary for the performance of the agreement with Tunity.

    • Legal obligation: the processing of personal data must be done so that Tunity can fulfill its legal obligations.

  • In a manner proportionate to the stated purpose;

  • In a proper way;

  • Basically during a period equal to five (5) years after the last activities on the website or five (5) years after the execution of the agreement;

  • In cases determined by law, during period equal to the statutory retention period;

  • In a manner that includes adequate safeguards against unauthorized access, unlawful processing and/or accidental loss or damage.


8.2. Right of access

Any Customer or Visitor who satisfactorily proves his or her identity has the right to obtain from Tunity confirmation as to whether or not personal data concerning him or her have been processed and, if so, to access the personal data.

In doing so, you have the right to receive information about the purposes of processing, the categories of personal data being processed, the recipients of the personal data, the (criteria to determine the) period (to be) during which your personal data will be stored and the rights you can exercise in accordance with the AVG.

Personal data that is incomplete or inaccurate can be corrected or erased at any time. You may exercise your right to correction by providing a supplemental statement to Tunity. Tunity will act on this within one (1) month of receiving the supplemental statement.

In addition, you have the right to have your personal data erased by Tunity without unreasonable delay. You can only exercise this right in the following cases, which Tunity will assess:

  • When your personal data are no longer needed for the purposes for which they were collected or processed;

  • When you withdraw your consent and no other legal basis exists for the processing;

  • When objection is made to the processing and no overriding compelling legitimate grounds for the processing exist;

  • When personal data have been processed unlawfully;

  • When your data must be deleted in accordance with a legal obligation.


8.3. Right to restriction of processing / right to object.

You have the right to obtain from Tunity a restriction on processing if any of the following apply:

  • You dispute the accuracy of the personal data;

  • Tunity's processing is found to be unlawful and you do not wish to erase the personal data, but you want a restriction on the processing;

  • Tunity no longer needs your personal data for processing purposes, but you still need it for the establishment, exercise or substantiation of a legal claim;

  • Tunity should assess the presence of the grounds for erasure of personal data and during this period. 

You also have the right to object at any time to the processing of your personal data due to reasons related to your specific situation. Tunity will then cease processing your personal data unless Tunity can provide compelling legitimate grounds for processing your personal data that outweigh your right to object.

In addition, you have the right not to be subjected to individualized and fully automated decision-making where this has legal consequences or where such a decision could significantly affect you. However, you can always intervene in such decision-making yourself or request human intervention.

Finally, you have the right to object to the processing of personal data for direct marketing at any time.

8.4. Right to data portability.

You have the right to obtain the personal data provided to Tunity in a structured, common and machine-readable form. In addition, you have the right to transfer these personal data to another controller when the processing of your personal data is based solely on your consent.

If you wish to exercise your right to data portability, Tunity will act on it within one (1) month of receiving the request. The request is made by registered mail or by sending an email to: [email protected]


8.5. Right to oblivion

Whenever you have rightly requested Tunity to rectify, erase or further limit the processing of data, Tunity will notify each recipient of this personal data, unless this proves impossible or would require unreasonable effort. You may also receive information about these recipients at any time.


8.6. Right to withdraw your consent / right to complain

You always have the right to withdraw your consent. The withdrawal of consent does not affect the lawfulness of the processing based on the consent before its withdrawal. In addition, you have the right to lodge a complaint regarding the processing of your personal data by Tunity with the competent supervisory authorities.

8.7. Right to information and transparency

When exercising your rights, Tunity will always act in accordance with the AVG and thus provide all information required by the AVG in a concise, transparent, understandable and easily accessible form which you will receive in a simple language.

Deadlines for responding to your requests may be extended in exceptional circumstances, including the complexity/multitude of your requests. To this end, Tunity will notify you of this extension and the reason for this extension within one (1) month of receiving your request.


8.8. Right to file a complaint

Therefore, Tunity takes appropriate technical and organizational measures to protect your personal data against destruction, loss, alteration, unauthorized processing or unauthorized access in order to prevent misuse.
